Terms of service

By installing or using EZ Layaway ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the App.

These Terms constitute a legally binding agreement between you (the "Merchant") and EZ Layaway ("we," "us," or "our"). "Merchant" refers to any Shopify store owner who installs and uses the App.

We reserve the right to update these Terms at any time. Material changes will be communicated with at least 14 days' notice. Continued use after the effective date constitutes acceptance of the updated Terms.

EZ Layaway is a Shopify app that enables merchants to offer layaway payment programs to their customers. The App allows merchants to configure layaway programs, accept down payments at checkout, manage instalment schedules, and automate payment reminders.

The App integrates with Shopify's platform via its official APIs and operates within the Shopify ecosystem. You must have an active Shopify store and agree to Shopify's terms of service to use EZ Layaway.

We provide the App on a subscription basis. The current subscription fee is $99 per month, billed through Shopify's standard app billing system. Fees are subject to change with 30 days' notice.

1. A 14-day free trial is available to new merchants upon first installation.
2. Billing begins automatically after the trial period unless you cancel.
3. There are no transaction fees beyond your normal Shopify payment processing costs.
4. Refunds for unused subscription periods are at our discretion.

As a Merchant using EZ Layaway, you are responsible for configuring your layaway programs correctly, including setting appropriate down payment amounts, instalment schedules, and eligibility rules for your products.

You are responsible for ensuring your use of EZ Layaway complies with all applicable laws and regulations in your jurisdiction, including consumer protection laws, payment regulations, and any laws governing instalment payment arrangements.

You acknowledge and agree that:

1. You will not use the App for fraudulent, deceptive, or illegal purposes.
2. You are the data controller for your customers' personal data processed through the App.
3. You will maintain an accurate and up-to-date privacy policy on your store.
4. You will honour all layaway contracts created through the App with your customers.

To the maximum extent permitted by applicable law, EZ Layaway and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.

Our total liability to you for any claim arising out of or relating to these Terms or the App shall not exceed the total amount you paid us in the three months preceding the claim.

We do not warrant that the App will be error-free, uninterrupted, or free of harmful components. We provide the App "as is" and "as available" without warranties of any kind, express or implied.

EZ Layaway and all associated intellectual property, including the software, design, trademarks, and documentation, are owned by us or our licensors. These Terms do not grant you any right, title, or interest in the App beyond the limited licence to use it as described herein.

You grant us a non-exclusive, royalty-free licence to use your store's data solely to provide the App's services to you. We do not claim ownership over any data you or your customers provide.

You may terminate your use of EZ Layaway at any time by uninstalling the App from your Shopify store. Uninstalling will cancel your subscription at the end of the current billing period.

We may suspend or terminate your access to the App immediately, without prior notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or pose a risk to other users or our platform.

Upon termination, your right to use the App ceases immediately. We will handle your data in accordance with our Privacy Policy and applicable data retention obligations.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
